Terms of Service

The agreement between you and BookTarot governing your use of the platform. Includes jurisdictional riders for the EU/UK, US states, Canada, Australia, New Zealand, Brazil, and others.

These Terms of Service ("Terms") form a binding agreement between you and BookTarot Ltd. ("BookTarot", "we", "us"). By creating an account or using the BookTarot platform at booktarot.com (the "Platform"), you agree to these Terms. If you do not agree, do not use the Platform.

A note on legal review. These Terms have been drafted to a production standard. We recommend that any operator review them with qualified counsel admitted in each jurisdiction served before launch, particularly for state-by-state divergence in the United States, post-Brexit UK divergence, and EU member-state implementations of EU directives.

1. Who we are

BookTarot Ltd. operates an online marketplace that connects independent tarot readers ("Readers") with individuals seeking readings ("Clients"). The Readers are independent contractors and are not employees, partners, or agents of BookTarot. BookTarot provides the technology and trust layer; the reading itself is a service provided by the Reader.

2. Eligibility

You must be at least 18 years old to use the Platform (21 in jurisdictions where local law requires that threshold for divination services, including the United Arab Emirates, Saudi Arabia, Qatar, Kuwait, Oman, and Bahrain). By using the Platform, you confirm that you meet the applicable age threshold and that you have the legal capacity to enter into this agreement.

3. Nature of the services

Readings provided on the Platform are intended for entertainment, personal reflection, and self-exploration. They are not, and must not be presented as, a substitute for professional medical, legal, financial, psychological, or psychiatric advice. Readers are contractually prohibited from making medical diagnoses, providing legal counsel, recommending specific securities or financial products, or making predictions about third parties without those parties' consent.

In a number of jurisdictions (notably certain US states, including Pennsylvania, Louisiana, Maryland, and Nebraska, and certain US municipalities), fortune-telling services are addressed by specific statutes that require disclosures of an entertainment framing. BookTarot complies with such disclosure obligations across the Platform.

4. Account registration

To create an account you must provide accurate information and keep it current. You are responsible for activity that occurs under your account. Notify support@booktarot.com promptly if you suspect any unauthorized access.

Readers undergo additional verification, including identity verification through a trusted third-party provider, review of professional history and references, and acceptance of the Reader Agreement available at /legal/reader-agreement.

5. Bookings, payment, and refunds

When you book a session, you authorize a charge for the price displayed at checkout in your local currency (with the underlying transaction settled in the Reader's currency through Stripe Connect destination charges). Applicable taxes (VAT, GST, sales tax, JCT, etc.) are added at checkout based on your location using Stripe Tax.

Cancellation and refund terms:

  • Cancellations more than 24 hours before the scheduled start: full refund.
  • Cancellations within 24 hours: non-refundable, except as required by applicable consumer law in your jurisdiction (see Section 13 for jurisdictional riders).
  • Reader cancellations or no-shows: full refund to the Client, with the option to rebook.
  • Client no-shows: non-refundable, except as required by applicable consumer law.
  • Technical failure on our side that prevents the session: full refund or rebooking.

6. Reader payouts

Readers are paid the price of the session less BookTarot's platform fee, which is currently forty percent of the gross session price and disclosed transparently in the Reader Agreement with a worked example. Payouts are issued via the Reader's connected Stripe account on a rolling schedule.

7. Acceptable use

You agree not to: (a) impersonate any person, (b) harass, abuse, or discriminate against any user, (c) attempt to circumvent BookTarot to transact off-platform once a connection is established through the Platform, (d) record sessions without both parties' explicit consent through the platform recording feature, (e) use the Platform for any unlawful purpose, (f) scrape, mirror, or systematically extract content other than through the documented public APIs and sitemaps, (g) attempt to interfere with the Platform's security, or (h) misuse the dispute and reporting systems. 8. Reader content and moderation

Readers may post content (profile bios, photos, posts, replies to reviews). Such content remains the Reader's intellectual property; the Reader grants BookTarot a worldwide, royalty-free license to host, display, distribute, and adapt the content for the operation and promotion of the Platform. BookTarot may, in its reasonable discretion, hide, remove, or refuse to publish content that violates these Terms, the Acceptable Use Policy, or applicable law. Notice and action procedures, including transparency reporting consistent with the EU Digital Services Act, are described at /legal/dmca.

9. Reviews

Clients who have completed a paid booking may submit a review. Reviews are subject to moderation under the Community Guidelines at /legal/community. BookTarot does not delete reviews simply because a Reader objects to them; we will, however, remove reviews that violate our policies, are demonstrably false, or are submitted by parties who did not complete a booking.

10. Intellectual property

The Platform, including all software, design, text, graphics, and trademarks, is owned by BookTarot or its licensors. You may not copy, modify, or create derivative works of the Platform except as expressly permitted. The BookTarot name and logo are trademarks of BookTarot Ltd.

11. Disclaimers

THE PLATFORM AND THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOOKTAROT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

NOTHING IN THIS SECTION LIMITS RIGHTS YOU MAY HAVE UNDER MANDATORY CONSUMER PROTECTION LAW IN YOUR JURISDICTION, INCLUDING THE NON-EXCLUDABLE GUARANTEES UNDER THE AUSTRALIAN CONSUMER LAW, THE NEW ZEALAND CONSUMER GUARANTEES ACT, THE UK CONSUMER RIGHTS ACT 2015, AND EU MEMBER-STATE IMPLEMENTATIONS OF THE CONSUMER RIGHTS DIRECTIVE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOOKTAROT'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO BOOKTAROT IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS. NEITHER PARTY SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

The foregoing limitations do not apply where they are excluded or restricted by mandatory law in your jurisdiction.

13. Jurisdictional riders

13.1 European Union and European Economic Area

For consumers resident in the EU or EEA, the following apply alongside the rest of these Terms:

  • You have the right to a fourteen-day cooling-off period for contracts concluded at a distance under Directive 2011/83/EU. Because tarot readings are digital services with immediate performance, you expressly waive that right at checkout when you confirm a booking; this waiver is required to schedule the session.
  • Mandatory consumer protections under the law of your member state of residence apply notwithstanding our governing law clause.
  • You may bring claims in the courts of your member state.
  • The European Commission's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr.

13.2 United Kingdom

For consumers resident in the United Kingdom, the Consumer Rights Act 2015 applies. Statutory rights are not affected by these Terms. The fourteen-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 is waived by you at checkout for digital services with immediate performance.

13.3 United States

For US consumers: these Terms are governed by the laws of the State of Delaware without regard to conflict of laws principles. Any dispute shall be resolved by binding individual arbitration administered by JAMS in San Francisco, California, except for small-claims-court matters and except where you opt out within thirty days of accepting these Terms by sending notice to legal@booktarot.com. You and BookTarot waive any right to participate in a class action. Where state law (notably California, Pennsylvania, Louisiana, Maryland, Nebraska) requires specific disclosures for fortune-telling services, those disclosures are provided through the Platform and prevail to the extent of any conflict.

13.4 Canada

For Canadian consumers, the law of the province of Ontario governs, except that Quebec residents have the benefit of the Consumer Protection Act (CPA) and the Charter of the French Language. When serving Quebec, BookTarot provides core consumer-facing pages in French.

13.5 Australia

For Australian consumers, the Australian Consumer Law applies and overrides any inconsistent term. Nothing in these Terms excludes, restricts, or modifies any non-excludable guarantee.

13.6 New Zealand

For New Zealand consumers, the Consumer Guarantees Act 1993 applies.

13.7 Brazil

For Brazilian consumers, the Código de Defesa do Consumidor applies. You have a seven-day reflection period under article 49 of the CDC where the contract is concluded outside business premises or by distance; this is waived at checkout for digital services with immediate performance.

13.8 Japan

For Japanese consumers, BookTarot complies with the Specified Commercial Transactions Act. Required information disclosures are provided on the checkout and contract pages.

13.9 Rest of world

For all other consumers, the law of England and Wales governs, and the courts of London have exclusive jurisdiction, subject to any mandatory protections in your local law.

14. Termination

You may close your account at any time through the account settings or by contacting support. We may suspend or terminate accounts that violate these Terms or applicable law. Sections that by their nature should survive termination (including Sections 10, 11, 12, 14, and 15) survive.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email and an in-app banner, and your continued use after the effective date of the updated Terms constitutes acceptance. For material changes that materially affect your rights or obligations, we will require an explicit re-acceptance.
